Workplace mediation
Mediation is a process where a neutral third party (the mediator) assists two or more parties in dispute to reach a voluntary, negotiated settlement of their differences.
The benefits of mediation in the workplace for dealing with problems or disputes include; identifying areas of mutual interest / gain, helping to clear up misunderstandings, allowing feelings to be vented and avoiding protracted / expensive litigation.
Before conducting any workplace mediation, we discuss with the client the mediation process that we use, the steps involved and whether mediation is appropriate in the circumstances.
Workplace dispute prevention / resolution advice
As far as practicable we encourage our clients to train and support their managers to recognise the potential triggers for disputes in the workplace and to take proactive steps to prevent small problems from becoming much larger (and usually more expensive to resolve).
We provide a consulting service to clients that involve an analysis of the client’s business or activity and the types of people related risks / issues that may arise.
From this analysis, clients are then provided with a suite of options / measures to help ameliorate these risks.
We also consult on single issues and can act as a “sounding board” for HR managers or staff with responsibility for dealing with workplace disputes.
Workplace relations advice
We provide organisations with advice regarding their obligations under the Fair Work Act 2009 (Cth) as well as advice regarding conduct / performance matters, employee grievances and workplace policies.
Our firm is also able to refer clients to accredited employment lawyers where matters may involve potential or actual litigation.
Workplace reviews & investigations
Often, the best ideas for improving a workplace come from the people “at the coalface”.
Our process of workplace review involves not only an examination of policies and procedures, but speaking to staff at all levels to gain an understanding of the organisation, what it does well, what could be improved and then how to turn this information into practical outcomes that can be measured.
Through our process of staff engagement, we have helped organisations turn the “problems that everyone knows about ” into opportunities for workplace improvement.
The Director also conducts workplace investigations of grievances and matters involving allegations of workplace bullying or harassment.
